42dot Open Dataset License Agreement
To promote future development of self-driving cars 42dot is opening to the public a set of autonomous driving data that can be used for research on machine learning models. The dataset provided in this website is made available free of charge, but under the terms and conditions(the “License Agreement”) below.
1. Definitions
1.1
“Dataset" means the 42dot Open Dataset originally available at https://42dot.ai/akit/dataset/(the “Website”) and any data in the 42dot Open Dataset.
1.2
“42dot" means 42dot Inc and its subsidiaries.
1.3
“You" means individual(s) or entity(ies) exercising the rights granted under this License Agreement.
2. Licenses
2.1
Unless specifically labeled otherwise, the Dataset is provided to You under a Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International Public License (“CC BY-NC-SA 4.0”), with the additional terms included herein. The CC BY-NC-SA 4.0 may be accessed at https://creativecommons.org/licenses/by-nc-sa/4.0/legalcode
2.2
When You download the Dataset or use the Dataset You are agreeing to comply with the terms of CC BY-NC-SA 4.0 as applicable, and also agreeing to this License Agreement. Where the terms of this License Agreement conflict with the terms of CC BY-NC-SA 4.0, the terms this License Agreement shall prevail.
2.3
You acknowledge and agree that some Dataset and indicators are provided by third parties and may not be redistributed or reused without consent of original data providers, or may be subject to terms and conditions that are different from this License Agreement. Where applicable, these conditions are included in the dataset or indicator metadata.
3. Ownership and Limited License
The Dataset and Website, including the images, text, graphics, animations, photos, videos, illustrations and other content contained therein, are owned by 42dot or its licensors, users, or other third parties and are protected under both Korean and foreign laws. Except as explicitly stated in this License Agreement, all rights in and to the Dataset and Website are reserved by 42dot or its licensors. Any use of the Dataset and Website other than as specifically authorized herein, without prior written permission, is strictly prohibited and will terminate the license granted herein.
4. Trademarks
42dot and its other marks, logos, product or service names, slogans and the look and feel of the Website are trademarks of 42dot and may not be copied, imitated, or used, in whole or in part, without prior written permission. Other trademarks, registered trademarks, product names and company names or logos mentioned on the Website are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by 42dot.
5. Termination
5.1
42dot may terminate Your access to all or any part of the Dataset at any time, with or without cause, with or without notice, effective immediately. If You wish to delete your personal information, You may notify 42dot at dataset@42dot.ai
5.2
Use of Dataset is subject to applicable laws and regulations, including, but not limited to, export regulations, and 42dot may decline to grant a license, and/or elect to terminate a license with respect to any You, in the event that such Your actual or proposed use of Dataset (i) is not permitted under applicable laws or regulations, (ii) fails to comply with this License Agreement, or (iii) has the potential to negatively impact 42dot’s reputation.
5.3
All provisions of this License Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability and indemnity.
6. Warranties
THE DATASET AND WEBSITE(INCLUDING, WITHOUT LIMITATION, ALL CONTENT AND MODIFICATIONS OF ORIGINAL DATASET POSTED ON THE WEBSITE) ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. WITHOUT LIMITING THE FOREGOING, 42DOT DOES NOT WARRANT THAT: (A) THE CONTENT OR MODIFICATIONS TO THE DATASET ARE TIMELY, ACCURATE, COMPLETE, RELIABLE OR CORRECT IN THEIR POSTED FORMS AT THE WEBSITE; (B) THE WEBSITE WILL BE SECURE; (C) THE WEBSITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (D) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (E) THE WEBSITE, CONTENT OR ANY MODIFICATIONS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (F) THE RESULTS OF USING THE WEBSITE WILL MEET YOUR REQUIREMENTS. LICENSEE’S USE OF THE WEBSITE, THE DATASET, AND ANY CONTENT IS SOLELY AT LICENSEE’S OWN RISK.
7. Limitation of liability
IN NO EVENT SHALL 42DOT AND ITS AFFILIATES, OR THEIR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL THEORY WITH RESPECT TO THE WEBSITE, THE DATASET, OR ANY CONTENT OR YOUR SUBMISSIONS (I) FOR ANY DIRECT DAMAGES, OR (II) FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER.
8. Indemnification
You will indemnify and hold 42dot harmless from and against any and all loss, cost, expense, liability, or damage, including, without limitation, all reasonable attorneys’ fees and court costs, arising from (i) Your use or misuse of the Dataset or Website; (ii) Your access to the Website; (iii) Your violation of this License Agreement; or (iv) infringement by You, or any third party using Your account, of any intellectual property or other right of any person or entity, including but not limited to infringements upon any and all representations made by You in this Agreement.
9. Dispute Resolution
This License Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Korea (without regard to its conflicts or choice of law principles). All disputes under this License Agreement will be resolved in the Seoul Central District Court of Korea. You consent to the jurisdiction of such courts and waive any jurisdictional or venue defenses otherwise available.
10. Miscellaneous
10.1
42dot may assign, transfer or delegate any of its rights and obligations hereunder without consent. No agency, partnership, joint venture, or employment relationship is created as a result of this License Agreement and neither party has any authority of any kind to bind the other in any respect outside the specified in the License Agreement. In any action or proceeding to enforce rights under this License Agreement, the prevailing party will be entitled to recover costs and attorneys’ fees.
10.2
This License Agreement may be amended by 42dot from time to time at 42dot’s sole discretion, so please visit this page periodically to review them. By continuing to use the Dataset subsequent to making available an amended version of the License Agreement, You acknowledges, agrees and consents to such amendment.
10.3
You agrees that it is solely Your responsibility to comply with all applicable laws with regard to Your use or publication of the Dataset, including but not limited to any privacy, data protection, security, and export laws and You agrees to take reasonable steps to assist 42dot in fulfilling responsibilities to comply with applicable laws with regard to use or publication of Dataset.
